Terms of Service

Welcome to Floatdrive! These Terms of Service ("Terms") govern your access to and use of the Floatdrive website and services (collectively, the "Service"), provided by Floatdrive ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

§Description of the Service

Floatdrive is a cloud-based file storage and management platform. Our service allows users to securely upload, store, organize, and share files and folders of any type. Users can access their files from any device with internet access. Additionally, Floatdrive provides the option to embed files via iframe and protect them with passwords.

§User Files and Folders

By uploading files and folders to the Serivce, you grant the Service a worldwide, royalty-free, non-exclusive license to use, distribute, modify, adapt, and perform the files and folders solely for the purpose of providing the Service to you. This license remains in effect even if you cease using the Service or delete your files and folders from the Service.

While the Serivce does not access or read the direct content of your files and folders, we reserve the right to perform necessary processing, encryption, and optimization to facilitate the storage, management, and sharing of your files. This may include but is not limited to file compression, encryption for security purposes, and optimization for performance.

In the event of violations, including but not limited to copyright infringement, the Service will apply the rules outlined in the DMCA and Copyright Infringement section of this Terms to address the issue and take appropriate action.

§Safety and Security

Floatdrive takes the safety and security of your data seriously. We employ industry-standard security measures, including encryption and secure transmission protocols (AES-256 and TLS), to protect your files and personal information from unauthorized access, disclosure, alteration, or destruction. However, please note that no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

§Interruptions and Data Problems

While we strive to provide a reliable and uninterrupted service, Floatdrive does not guarantee that the Service will be error-free, secure, or uninterrupted at all times. We may experience occasional interruptions, delays, or errors due to factors beyond our control, including but not limited to maintenance, technical issues, or force majeure events.

§Subscriptions

Floatdrive operates on a monthly subscription basis. Details about our subscription plans, including features and pricing, can be found on our website in the pricing section. All payments for the Serivce subscriptions are processed through Stripe, a third-party payment processor. By subscribing to the Serivce, you agree to be bound by Stripe's terms of service and privacy policy. We do not store or have access to your payment information, as it is securely handled by Stripe. If your subscription expires or is not renewed, your access to the Service may be suspended or terminated. In such cases, all files and data associated with your account may become inaccessible. We reserve the right to delete your account and associated data after a reasonable period of time following the expiration of your subscription.

§Limitation of Liability

Floatdrive and its affiliates shall not be liable for any damages, losses, or liabilities arising from your use of the Service, including but not limited to:

  • Interruptions, delays, or errors in the Service
  • Loss of data or corruption of files
  • Unauthorized access to or disclosure of your data
  • Any indirect, incidental, special, or consequential damages

§Indemnification

You agree to indemnify and hold Floatdrive and its affiliates harmless from any claims, damages, losses, or liabilities arising from your use of the Service or your violation of these Terms, including any third-party claims resulting from your content or use of the Service.

§Abuse and Violations

Floatdrive prohibits the use of the Service for any unlawful or abusive purpose, including but not limited to:

  • Uploading, storing, or sharing files that infringe upon the intellectual property rights of others
  • Uploading, storing, or sharing files that contain illegal or harmful content, including malware, viruses, or explicit material
  • Engaging in any activity that violates applicable laws or regulations

We reserve the right to suspend or terminate your access to the Service, remove or disable any content, or take other appropriate action if we determine, in our sole discretion, that you have violated these Terms or engaged in abusive or unlawful conduct.

  1. Send a notification (a "DMCA Takedown Notice") through Report Abuse page.
  2. In your DMCA Takedown Notice, please include:
    • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
    • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
    • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an email address.
    • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  3. Upon receipt of a valid DMCA Takedown Notice, we will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material of your claim.

§Refunds and Disputes

In the event of disputes or concerns regarding your subscription or the Service, including requests for refunds, please contact us using this form. We will evaluate each case individually and discuss potential resolutions via email.

§Governing Law and Dispute Resolution

These Terms constitute the entire agreement between you and Floatdrive regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

§Changes to this Terms

We may update this Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any changes by posting the updated Terms on our website with a new effective date. Your continued use of the Service after the posting of the updated Terms constitutes your acceptance of the changes.
